Joint Intelligence Objectives Agency JIO4 27 April 1946 MEMORANDUM FOR (ILLEGIBLE) GENERAL S.J. (ILLEGIBLE) (ILLEGIBLE) SUBJECT: Delays Encountered in the Department of Justice in Preventing the Immigration into the United of German Scientists. 1. With the exception of one case, the Joint Intelligence Objectives Agency has been unable to effect the immigration into the United States of the German scientists and technicians brought to this country under Project Paperclip. The inability of this agency to successfully accomplish this program has been due to the fact that clearance of the specifically ILLEGIBLE cannot be obtained from the Department of Justice. In fact, no information concerning request for clearance, either approving or disapproving, ILLEGIBLE obtained from the Department of Justice. In view of the already ILLEGIBLE which has been incurred in this program, the Director, ILLEGIBLE, ILLEGIBLE that high level action be taken immediately which will incur prompt facilitation of the immigration of these ILLEGIBLE. FACTS 2. The following pertinent facts are ILLEGIBLE: a. By SEHCC 257/5 of 4 March 1946 a government policy was established to facilitate the entry into the United States, under ILLEGIBLE immigration ILLEGIBLE, of outstanding German scientists and technicians whose entry ILLEGIBLE in the ILLEGIBLE of the national security or in the national interest. This policy ILLEGIBLE occurred in by the Secretary of State and the Attorney General (ILLEGIBLe SEHCC 257/11 and SEHCC 257/25). b. By SEHCC 257/24 of 10 October 1946, a governmental policy ILLEGIBLE established which provided, an ILLEGIBLE ILLEGIBLE ILLEGIBLE, for the expeditious entry into the United States of German scientists and their facilities ILLEGIBLE by the military services. c. The Department of Justice concurred in and approved those policies and in SEHCC 257/25 agreed to expedite the immigration process. d. In a letter dated 1 October 1946, addressed to the Secretary of State, the Attorney General stated, in reference to the German scientists nd members of their families who were recommended by the military services for immigration, that the Department of Justice "shall complete, with such assistance as will be required from the War and Navy Departments, to ILLEGIBLE the immigration status of these person." 1 e. As a result of conferences held ILLEGIBLE representatives of the Department of State and Justice and the military services, procedures were established for processing the immigration of the German scientists and their families. These procedures ILLEGIBLE for ILLEGIBLE of each ILLEGIBLE by the Department of Justice ILLEGIBLE ILLEGIBLE to the Department of State on the one (1) ILLEGIBLE which ILLEGIBLE the Department of Justice and recommended to the Department of Justice ILLEGIBLE immigration ILLEGIBLE, indicators that the Department of State will ILLEGIBLE to the processing of immigration visas. f. Since 26 October 1947, the Joint Intelligence Objective Agency has forwarded to the Department of Justice the ILLEGIBLE of seventy (70) German scientists for whom clearance was requested. Only one (1) of the ILLEGIBLE forwarded has been cleared. During this period of time ILLEGIBLE conversations and conferences have taken place between representatives of JIOA and the Department of Justice ILLEGIBLE to the clearance of ILLEGIBLE ILLEGIBLE. The conversations and conferences have disclosed that ILLEGIBLE in processing clearance of the scientists is due to the fact that the ILLEGIBLE is making a full ILLEGIBLE investigation of each scientist and that until the FBI considers that each investigation has been completed, clearance cannot be given by the Department of Justice. DISCUSSION 3. Taken on its face value, the action taken by the Department of Justice appears neither unreasonable nor objectionable. It certainly appears that their action is in the interest of the internal security of the United States. However, when carefully analyzed, a different view is presented. 4. During the time when delays were being ILLEGIBLE in the Department of State, the representatives of the Department of Justice ILLEGIBLE, ILLEGIBLE cooperative attitude and reiterated ILLEGIBLE and ILLEGIBLE ILLEGIBLE ILLEGIBLE the problems with the State Department were solved, the Department of Justice was ILLEGIBLE and willing to cooperate and ILLEGIBLE the ILLEGIBLE ILLEGIBLE processor in every possible way. 5. Since the initial efforts to immigrate the Germans scientists into the United States, the responsibility for this progress within the Department of Justice has been transferred five times. At various phases their ILLEGIBLE has been handled by Dr. Edward Shufhmerry, Mr. H. Gehan Herison, Mr. Peyton Ford, Mr. William A. Underhill, Mr. Edward S. Lezowoke, Dr. ILLEGIBLE Hamilton, Jr. and Mr. William E. Joley. The ILLEGIBLE gentlemen are currently responsible for the program within the Department of Justice. 6. In the course of the conversations and conferences which have taken place, the representatives of the Department of Justice have repeatedly assured the Director, JIOA, that action was being taken to process the immigration of the scientists and that results 2 would be fortcoming in a matter of days or at the most in a couple of weeks. After several months of such promises and when pressed for more specific reasons for delay, Mr. Underhill informed the Director, JIOA, that the FBI men ILLEGIBLE the scientists and that until they (the FBI) had checked some more ILLEGIBLE, ILLEGIBLE could be done about it, nor could he make any ILLEGIBLE, or to the progress being made in the FBI. When informed that the military services were concerned about the delay and slow progress being made, Mr. Underhill replied to the effect, "Send the Generals and Admiral ILLEGIBLE, ILLEGIBLE ILLEGIBLE tell them about it." Granting that such a statement may have been ILLEGIBLE and therefore should not be taken seriously, it does reflects and ILLEGIBLE indifferent attitude concerning this ILLEGIBLE. 7. In a memorandum dated 6 November 1947 to MR. H. ILLEGIBLE ILLEGIBLE, Assistant Attorney General, Mr. J. Edgar Hoover ILLEGIBLE, ILLEGIBLE , ILLEGIBLE have stated in previous memoranda in regard to this project. ILLEGIBLE membership by any individual in the Nazi Party ILLEGIBLE ILLEGIBLE. For ILLEGIBLE to the granting of American citizenship and ILLEGIBLE ILLEGIBLE individual ILLEGIBLE a long record with the Nazi Party is a threat for the ILLEGIBLE ILLEGIBLE of the United States." Attempts on the part of the Director, ILLEGIBLE to obtain information from the FBI concerning clearance or to ILLEGIBLE ILLEGIBLE or ILLEGIBLE the ILLEGIBLE scientists program with Mr. Hoover have been ILLEGIBLE. 8. The delay in processing the immigration of scientists, ILLEGIBLE already been encountered in FBI and the fact, that Mr. Hoover personally ILLEGIBLE much great importance to membership in the Nazi Party, leads to the conclusion that extensive future delays can be expected in processing every ILLEGIBLE recommended. While recognizing the fact that the internal security of the United States in the responsibility of the FBI, and one with which they are always concerned, it can be most affirmatively stated that the military services are not equally concerned with barring the entrance into the United States of any person who was or in ILLEGIBLE in his beliefs and faith in a totalitarian ILLEGIBLE of government. Because of their concern for the internal security of the United States, the military services are taking great care and precaution to prevent the recommendation for entry of any such person. 9. Security investigations conducted by the military have disclosed the fact that the majority of German scientists were members of either the Nazi Party or one or more of its affiliates. There ILLEGIBLE discloses further that with a very few exceptions, such membership was due to ILLEGIBLE which influenced the liver of every citizen of Germany at that time. It is the opinion of the Director, JIOA, that to continue to give such ILLEGIBLE and grave consideration to Nazi affiliations which were destroyed with the recent ILLEGIBLE without giving due weight to the ILLEGIBLE circumstance under which such affiliations were formed, is placing an ILLEGIBLE ILLEGIBLE ILLEGIBLE ILLEGIBLE which no longer exists and appears to be predicted on a ILLEGIBLE consideration. It is difficult to understand why, in the face of the threat of ILLEGIBLE the security of the United States, such a concentration and developing investigation must be instigated in the ILLEGIBLE of there ILLEGIBLE who ILLEGIBLE ILLEGIBLE end invaluable contributions to the national security of this nation through their scientific and technical efforts. In light of the ILLEGIBLE existing in 3 then gain the valuable information and ability possessed by those men. Such an eventuality could have a most serious and adverse effect on the national security of the United States. 10. The continued and prolonged delay ILLEGIBLE ILLEGIBLE the ILLEGIBLE ILLEGIBLE into this country is causing the anxiety and ILLEGIBLE ILLEGIBLE ILLEGIBLE of their future. Those whose facilities are, ILLEGIBLE ILLEGIBLE, ILLEGIBLE Germany are worried about the welfare and ILLEGIBLE of the ILLEGIBLE ILLEGIBLE extended separation to which they have been subjected ILLEGIBLE ILLEGIBLE ILLEGIBLE ILLEGIBLE to return to their families in Germany. This situation is ILLEGIBLE ILLEGIBLE ILLEGIBLE the morale of the ILLEGIBLE and is not cohesive to ILLEGIBLE ILLEGIBLE ILLEGIBLE the maximum potential benefits are not being ILLEGIBLE from ILLEGIBLE ILLEGIBLE efforts and until such distractions are eliminated, the ILLEGIBLE and ILLEGIBLE programs of the military services will be adversely affected. 11. As long as the specialists are in an ILLEGIBLE, the military services must maintain a limited military custody in addition to ILLEGIBLE custody over them. This ILLEGIBLE cumbersome and unnecessary ILLEGIBLE the burden on the military services which involve ILLEGIBLE complex ILLEGIBLE, the military services will have to continue to carry ILLEGIBLE ILLEGIBLE until ILLEGIBLE is accomplished or the specialists are repatriated to Germany. The ILLEGIBLE recourse, in many cases, would be prejudiced to the national security. CONCLUSIONS 12. The Department of Justice has not, and is not, fulfilling there ILLEGIBLE or responsibilities which were ILLEGIBLE in governmental policies to ILLEGIBLE in the facilitating of the immigration of German specialists. 13. As a result, the Department of Justice is delaying the ILLEGIBLE of these specialists. 14. This delay is being incurred within the Department of Justice because of the extensive investigations of the specialists which are being conducted by the Federal Bureau of Investigation. There investigations are being conducting in view of the fact that the specialists were or might have been ILLEGIBLE of the Nazi Party or one of its affiliations organizations. 15. Although the majority of the specialists were ILLEGIBLE of either the Nazi Party or its affiliations, extensive security, investigations by the military services have revealed that those who have been recommended for immigration are good security risks for residence in the United States. 16. Continued delay in the immigration of the German specialists is adversely affecting their morale and consequently the ILLEGIBLE of the research and development programs of the military services. The delay further ILLEGIBLE a prolonged and unnecessary administrative burden on the military services. 17. Prompt action should be taken ILLEGIBLE ILLEGIBLE ILLEGIBLE facilitating and expediting the immigration of German scientists and their families. RECOMMENDATIONS 18. The Director, JIOA, recommends that the inclosed letter, or one of similar content, be forwarded to the Attorney General from the Secretary of the Army. ILLEGIBLE N.
