NEPA Oversight of Classified Programs The Advisory Committee is chartered to investigate intentional released of radioactive materials into the environment. Advisory Committee staff members have spoken with officials at several federal agencies about environmental oversight for classified defense programs, in an effort to understand how current regulations might address similar released if they were to occur today. These discussions identified several questions that are important to providing that understanding. To insure that the Advisory Committee's report accurately reflects current regulatory procedures, we request answers to the following questions. Please feel free to provide any additional information that would clarify these questions. 1. Under the National Environmental Policy Act, does EPA review in full (including any classified portions) every Environmental Impact Statement that is classified in whole or in part? 2. Does EPA have facilities to keep classified NEPA documents, including Environmental Impact Statements? Does EPA maintain files of classified NEPA documents? 3. How many people does EPA have with suitable clearances to review NEPA documents for "black" (Special Access Required or SAR) defense programs? 4. Does EPA maintain records of its NEPA reviews of classified programs, including classified Environmental Impact Statements? How many classified Environmental Impact Statements has EPA reviewed in the past five years? Deadline: 03/31/95
